Formal Personnel Complaint
Requirements for making formal complaints:
Personnel Complaints will be handled in accordance with Vernon's Annotated Civil Statutes, Article 6252-20 and Lone Star College Police Department Policies and Procedures.
Article 6252-20 Complaints Against Law Enforcement Officers; Writing; Signature
In order that a complaint against a law enforcement officer of the State of Texas, including but not limited to officers of the Department of Public Safety and the Liquor Control Board, or against a fireman or policeman may be considered by the head of the state agency or by the chief or head of a fire department or police department, neither of which is under the protection of a civil service statute, the complaint must be placed in writing and must be presented to the affected officer or employee within a reasonable amount of time after the complaint is filed and before any disciplinary action may be taken against the affected employee.
Chapter 37, Texas Penal Code
Sec. 37.02 Perjury
a) A person commits an offense if, with intent to deceive and with knowledge of the statements meaning:
1) He/she makes a false statement under oath or swears to the truth of a false statement previously made; and
2) The statement is required or authorized by law to be made under oath.
b) An offense under this section is a Class "A" misdemeanor.
Sec. 37.03 Aggravated Perjury
a) A person commits and offence if he/she commits Perjury as defined in Section 37.02 of this code, and the false statement:
1) Is made during or in connection with an official proceeding; and
2) Is material
b) An offense under this section is a Felony of the third degree.
Sec. 37.10 Tampering with Government Record
a) A person commits an offense if he/she:
l) Knowingly makes a false entry in, or false alteration of, a governmental record.
b) An offense under this section is a Class "A" misdemeanor unless the actor's intent is to defraud or harm another, in which event the offense is a Felony of the third degree.
